Sfax
Attestations that a declaration of intention to invest has been
submitted, either on the spot or on
line via API’s website.

Geographic coverage: desk - API – One-stop shop -API - Tunis
The geographic coverage of the API desk at the one-stop
shop located at API/Tunis is determined by where the new business will be
located:
Undertakings with no foreign holdings and/or falling under the terms of
law n° 2002-101 of 17 December 2002 (Art. 19 and 20): projects to be
located in the governorates of Tunis, Ariana, Ben Arous and Manouba
Projects with foreign participation, projects launched by Tunisians
resident abroad, and hydrocarbon projects: the API desk is in charge of
helping to establish these activities, regardless of where the project
will be located

The API desk at the one-stop shops located at API
offices in Sousse and Sfax is empowered to accept declarations of
intention to invest, in line with the following:
Declarations for industrial and service projects: setting up,
expansion and renewal
Declarations for industrial and service projects (setting up and
expansion) falling under the terms of law n° 2002-101 of 17 December 2002
(Art. 19 and 20)

to a change of investment regime
Geographic coverage: desk - API

The territory covered by API’s desk at the one-stop shop is determined by
the intended location of the project:
Projects with or without foreign participation in capital and those
falling under the terms of law n° 2002-101 of 17 December 2002 (Art. 19
and 20): Projects expected to be located in the governorates of Sousse
and Sfax
Projects with foreign participation: The API desk is in charge of
such initiatives, regardless of the geographic location of the project.
Time frame for receiving an
attestation that a declaration of intention to invest has been submitted:

One-stop shop - API - Tunis: 24 hours from the date and hour of
submission of a declaration of intention to invest, on the spot or on line
via the Agency’s website
One-stop shop - API Sousse and Sfax: 24 hours from the date and
hour of submission of a declaration of intention to invest, on the spot or
on line via the Agency’s website
72 hours, for
declarations involving industrial projects with investment of at least 2
million dinars, service projects located in a regional development zone,
and projects to set up culinary oil plants with majority foreign holdings

For those projects subject to authorization, you need to provide:
a copy of prior
authorization, agreement in principle or specifications, duly signed and
submitted to the administration in charge of the activity
For liberal professions, you need to provide:
copy of membership in
the relevant professional registry
Industrial and service projects with foreign participation in capital
plans to set up a new business
anywhere in Tunisia
copy of the promoter’s
national identity card (or passport for foreigners)
project declaration,
duly completed, available at the one-stop shop or on line via the website
For projects subject to authorization, you need to provide:
copy of the prior
authorization, agreement in principle or specifications, signed and
submitted to the administration in charge of the relevant activity
Projects promoted by
Tunisians resident abroad, upon definitive or provisional return
plans to set up a new business or expand
activities
anywhere in Tunisia
copy of the promoter’s
national identity card
pre-printed project
declaration form, duly completed, available at the reception desk of the
one-stop shop or at the desk in charge of handling the file
copy of the national
identity card and passport (pages 1, 2, and 3)
declaration made on
one’s honor (pre-printed form available at the desk)
confirmation of arrival
of equipment and/or vehicles
copy of the technical
visit carried out by the governmental supervisory department
copy certified to be in
conformity with the original act pertaining to the customs visit
For equipment acquired locally, you need to provide:
invoice or contract for purchase of equipment, along with an affidavit
from a notary process server
commitment to the effect that equipment or vehicles will not be resold
before expiry of the five-year time frame from the date when the customs
exemption incentive was awarded
draft statutes for the business to be set up
NB. Evaluation of equipment, the object of
the input in kind being the basis for purchase invoices
Evaluation of transport material made on the basis of an estimate by the
Directorate General of Customs
For projects subject to authorization, you need to provide:
copy of the prior
authorization, agreement in principle or specifications, signed and
submitted to the relevant administration
For liberal professions, you need to provide:
copy of membership in
the professional organization
For expansion, you need to provide a monitoring report by the services of
the relevant API regional office.

NB. Service companies in the hydrocarbons
sector, generally called para-oil companies, provide license or
concession-holders with services directly linked to exploration and
production of oil and gas. These services in certain cases include supply
of products or equipment linked to the service rendered.
